Agreement Between User and PNW Foundations
This website is operated by PNW Foundations ("we," "us," or "our"). It is offered to you conditioned on your acceptance without modification of the terms and conditions set out here.
By visiting this site, submitting the inspection request form, or otherwise communicating with us through this site, you accept these terms. If you do not agree with them, please do not use the site or submit the form.
What This Service Is
This site exists to help homeowners find out whether their foundation has moved, and by how much. When you submit the form, we arrange a free on-site inspection performed by an inspector.
PNW Foundations is not a contractor and does not perform repair work. Any repair work that follows is performed by a separate contractor under its own agreement with you, together with whatever engineering and permitting that job requires, at that contractor's or engineer's own fees. Submitting the form does not create a contract for construction work and does not obligate you to purchase anything.
The Free Inspection
The inspection is provided at no cost and with no obligation. During the visit, an inspector will assess visible conditions, take measurements, and explain what those measurements indicate.
An inspection reflects conditions observed on the day of the visit and is limited to areas that are safely and reasonably accessible. It is not a structural engineering report, a home inspection as defined under Washington law, a warranty, or a guarantee about the future performance of your home. Conditions in a building can change, and concealed conditions may exist that no visual inspection would reveal.
We may decline to schedule or complete an inspection for any lawful reason, including properties outside our service area or conditions that make a visit unsafe.
Not Engineering, Legal, or Real Estate Advice
Nothing on this site or communicated during an inspection is engineering, legal, financial, insurance, or real estate advice, and none of it should be relied on as a substitute for a licensed professional engaged directly by you.
If you are buying or selling a home, involved in a dispute, making an insurance claim, or making decisions with legal or financial consequences, consult a qualified professional of your own choosing.
Consent to Be Contacted
Consent to receive automated calls or texts is not a condition of booking an inspection or purchasing anything. You may request an inspection without giving that consent.
If you check the consent box on our form, you agree that PNW Foundations and the contractor partners identified on our site may call and text you at the number you provided regarding your inspection, including by automated dialing systems or prerecorded messages.
Message and data rates may apply, and message frequency varies. You may reply STOP to any text message to opt out, or HELP for assistance. Opting out of texts does not withdraw a request you have already made; contact us directly if you want your request cancelled.
If you do not check the box, we may still contact you about the request you submitted using ordinary, non-automated means.
We keep a record of the consent language displayed to you, whether you checked the box, and when you submitted the form.
Privacy
Your use of this site is also governed by our Privacy Policy, which describes what information we collect, how it is used, and the choices available to you. By using this site you consent to the practices described there.
Electronic Communications
When you submit the form or email us, you are communicating with us electronically and consent to receive communications from us electronically. Agreements, notices, and disclosures we provide electronically satisfy any legal requirement that they be in writing.
Eligibility and Age
This site is intended for users who are at least 18 years old and who own, or are authorized to act for the owner of, the property in question. We do not knowingly collect personal information from children. If you believe a child has provided us information, contact us and we will delete it.
This site is directed to users in the United States. If you access it from elsewhere, you are responsible for compliance with your local laws.
Information You Provide
You agree that the information you submit is accurate and that the phone number and email address you give are yours to provide. Submitting someone else's contact details without their permission is a misuse of this site.
Do not send us sensitive personal information through this site. The form is for arranging an inspection and needs nothing more than your name, address, email, and phone number.
Third-Party Sites and Service Providers
This site may link to sites we do not control, and we use third-party service providers to host the site, deliver form submissions, and handle communications. We are not responsible for the content, policies, or practices of any third party, and a link is not an endorsement.
Intellectual Property and Prohibited Use
The content on this site, including text, layout, graphics, and design, is our property or used with permission and is protected by applicable law. You may view and print pages for your own non-commercial use in evaluating our services.
You may not use this site to do anything unlawful or prohibited by these terms, including attempting to gain unauthorized access, interfering with its operation, scraping or harvesting data, submitting false or automated form entries, or reproducing our content for commercial purposes without written permission.
Reliance on Site Information
Information on this site is general in nature and provided for convenience. Foundations, soils, and drainage vary enormously from one property to the next, and general information cannot tell you what is happening at yours. Service Area
Inspections are available only within our published service area. If your property falls outside it, we will tell you rather than schedule a visit, and we may suggest other options. Availability, scheduling, and the scope of any work offered are subject to change.
Indemnification
You agree to indemnify and hold harmless PNW Foundations, its owners, employees, agents, and contractor partners from any claim, demand, loss, or expense, including reasonable attorneys' fees, arising from your use of this site, your breach of these terms, or your violation of any law or the rights of a third party.
Disclaimer of Warranties
This site and the information on it are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement. We do not warrant that the site will be uninterrupted, secure, or error-free.
This section concerns the website and its content. It does not limit any written warranty that may be provided separately with contracted repair work.
Limitation of Liability
To the fullest extent permitted by law, PNW Foundations will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising out of your use of this site, whether based in contract, tort, strict liability, or otherwise, even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so parts of this section may not apply to you.
Arbitration
Any dispute arising out of or relating to these terms or this website that cannot be resolved informally will be settled by binding arbitration administered under the Federal Arbitration Act, conducted in King County, Washington, before a single arbitrator. The arbitrator's decision may be entered as a judgment in any court of competent jurisdiction.
Either party may bring an individual claim in small claims court instead, if it qualifies. This section concerns disputes about this website and these terms; a separate signed construction contract may contain its own dispute provisions, which will govern that contract.
Termination and Governing Law
We may terminate or restrict access to this site at any time, without notice, at our sole discretion. These terms are governed by the laws of the State of Washington, without regard to its conflict of law provisions. Subject to the arbitration section above, you consent to the exclusive jurisdiction of the state and federal courts located in King County, Washington.
If any provision of these terms is found unenforceable, the remaining provisions stay in effect.
Changes to These Terms
We may update these terms at any time. The effective date at the top of this page shows when they were last revised, and continued use of the site after a change means you accept the revised terms. Changes apply going forward and do not alter consent already given or withdrawn.
